摘要
构建解释论视野下跨区域水环境污染损害赔偿责任体制,分析解释论视野下环境污染罪定义,了解环境污染罪定罪条件;采用生产率评估法评估跨区域水环境污染损害导致的经济损失程度;构建民事责任,行政责任和刑事责任相结合的解释论视野下跨区域水环境污染损害赔偿责任体制,在不同形式责任中,基于水环境污染损害导致评估结果,承担不同程度的水环境污染损害赔偿。为改善中国跨区域水环境污染损害现状,提出以上市公司环境信息强制公开为基础的跨区域水环境污染损害防治建议。
        This paper constructs the liability system for compensation of water pollution damage in cross-region under the perspective of the explanatory theory. It analyzes the definition of environmental pollution crime under the perspective of the explanatory theory, and understands the conditions for the conviction of environmental pollution crime.It uses the productivity assessment method to assess the economic loss caused by cross-regional water pollution damage. The construction of a cross-regional water pollution compensation system under the perspective of the interpretation of civil liability, administrative liability and criminal liability, in different forms of liability, based on the results of the assessment of water pollution damage, to bear different degrees of water pollution compensation. In order to improve the current situation of cross-regional water pollution damage in China, the paper puts forward the proposal of cross-regional water pollution damage prevention and control based on the compulsory disclosure of environmental information of listed companies.
