论邮轮运输的功能属性——兼谈我国《海商法》第五章的修改途径

近年来邮轮旅游事故频发,处理邮轮事故时是否适用我国海上旅客运输规定存在争议。在我国邮轮包销模式下,邮轮运输行为不被界定为《中华人民共和国海商法》第五章的"海上旅客运输"。探讨邮轮运输的属性主要从两个方面出发,一是旅客运输的定义,另一是海上旅客运输界定。前者决定油轮运输是否为旅客运输,后者决定其是否为海上旅客运输。此外,再结合国际对邮轮运输属性的理解,得出邮轮运输既是旅客运输也是海上旅客运输的结论,并为我国《海商法》的修改提供新思路。
In recent years, cruise travel accidents occur frequently, and there is controversy over whether to apply the provisions of Chapter 5 of the Maritime Law of the People's Republic of China when dealing with cruise accidents. In China's cruise operating mode, cruise transportation is not defined as "carriage of passengers by sea in Chapter 5 of the Maritime Law of the People's Republics of China. The attribute of cruise transportation is derived from two aspects, one is the definition of carriage of passengers, and the other is the carriage of passengers by sea. The former determines whether cruise transportation is carriage of passengers, and the latter determines whether the cruise transportation is carriage of passengers by sea. In addition, combined with an international perspective of cruise transportation, it is concluded that cruise transportation is both of them,therefore, provides new ideas for the revision of the Maritime Law of the People's Republic of China.
