我国工伤认定制度的不足与完善

摘要
工伤认定是获得工伤救济的前提条件,是启动工伤赔偿程序的首要环节。2014年9月《最高人民法院关于审理工伤保险行政案件若干问题的规定》出台,对工伤认定的相关问题有了进一步的补充,在现实中有关工伤认定问题的关键因素如"工作时间""工作地点""上下班合理路线""因公外出"等还存在一些争议,对工伤认定制度还需进一步完善。
Injuries cognizance is the precondition of inductrial injury relief, is to start the first step of inductrial injury compensation program. In September 2014, the Supreme Court issued some issues about the trial of administrative cases of inductrial injury insurance regulations, made further supplement to the system of industrial injury. However, in practice there is some controversy about industrial injury. This article mainly from the major risk factors for industrial injury, starting from the Supreme Court judicial interpretation, puts forward some opinions for improvement of the system of industrial injury.
