传统与转型:改革开放四十年来中国反腐败立法理念之多维分析

摘要
改革开放四十年来中国反腐败立法理念经历了消极治理主义—积极治理主义—"零容忍"积极治理主义三个阶段的演进历程。鉴于当前反腐任务艰巨的形势,应确立"零容忍"积极治理主义的反腐败立法理念,以转变腐败治理模式,指导反腐败立法。中国反腐败立法理念的转型需要以法治思维与法治方式突破传统腐败治理思维,坚持渐进式、理性化、科学化,以推动立法理念的规范演进。
Since the reform and opening up 40 years ago, China's anti-corruption legislation concept has experienced three stages of evolution: negative governance—positive governance—"zero tolerance" positive governance. In view of the difficult situation of the current anti-corruption task, it is necessary to establish the concept of "zero tolerance" positive anti-corruption legislation, so as to change the corruption governance model and guide anti-corruption legislation. The transformation of China's anti-corruption legislation concept needs to break through the traditional corruption governance thinking with the legal thinking and the governing way by law, and adhere to the progressive, rational and scientific way to promote the normative evolution of legislative concept.
