《公共图书馆法》经费条款的立法论评析及改进建议

摘要
文章以立法论为理论基础,通过立法的本质、立法的目的和立法的续造性对《公共图书馆法》的经费条款内容进行评析,认为《公共图书馆法》的经费条款内容与立法的本质要求存在一定的距离,与立法的目的要求也存在一定的偏差,不足以彰显立法的续造性。《公共图书馆法》经费条款的未来改进应当以提高公共文化服务保障的强度,细化政府经费保障的责任范围并明确法律后果以及增设经费来源的多元化机制为方向。
Based on the theory of legislation,this paper analyzes the funds clauses in the Public Library Law in terms of the nature,purpose and continuation of legislation. It concludes that there is a gap between the content of the clauses and the essential requirements of the legislation. There is also a certain deviation from the requirements of the purpose of legislation, which fails to demonstrate the continuation of the legislation. Therefore, future improvements made on the clauses should be diversified,focusing on the enhancement of public cultural service,the refinement of the responsibilities of government funding, the clarification of legal consequences, and the increase of funding sources.
