摘要
食品安全问题是一项人们普遍关心的热点问题,它涉及到人们的健康,涉及到社会的发展和稳定,是一个重大的民生问题。但是我国食品安全现状堪忧,食品安全事故频频发生,给人们的生命健康造成较大损失。要提高我国的食品安全水平,必须切实提高食品安全行政执法水平。本文首先对食品安全行政执法的基本概念入手,为下文进行铺垫;接下来一部分论述食品安全行政执法的执法体制,分析了执法体制的历史沿革,然后论述了执法主体及其职能和权限,第四部分分析了食品安全行政执法的执法依据,即我国的食品安全法律体系,从法律、行政法规和部门规章三个角度进行了分析,并给予简要评价。下一部分重点论述了食品安全行政执法的执法手段,涉及到立法制度、食品安全标准制度、食品安全检验制度等等制度。第六部分对食品安全行政执法的执法困境进行分析,一一列举了我国食品安全行政执法过程中的不足,大体从执法体制与执法手段另个层面进行了分析。最后一部分针对食品安全行政执法的执法困境相应提出了执法对策,这对于提高我国食品安全水平,保障人们身体健康,促进经济社会发展具有重要意义。
Now people pay much attention to the question of food safety. It not only relates to the health of the people but relates to the development and stability of the society. So it is a significant question to people's livelihood. However, the level of food safety is not satisfactory, some food problems happen frequently and they do great harm to people’s health and safety. In order to improve the level of food safety, Government must strengthen the food safety supervision. This thesis frist analyses the basic concepts of administrative law enforcement on food safety, then discusses the system of the administrative law enforcement, Reviews the history of the system. Analyses the subjects and their functions of administrative law enforcement, The fourth part of this thesis analyses the legal basis of the administrative law enforcement,then makes some comments of it. The legal basis consists of national law、administrative regulation、administrative rules promulgated by agencies under the State Council. The next part discusses the meatures of administrative law enforcement, Which involves the legislative institution、standard institution、food test institution, and so on.. The sixth part analyses the problems of the administrative law enforcement, listing some probloms one by one at the process of administrative law enforcement. It is discussed from the perspective of the system of the administrative law enforcement and the meatures of administrative law enforcement. According to this part the last part puts forward the proposals. These proposals may not only contribute to the level of food safety but also make people healthier. Forthermore, They can also contribute to the development of the economy and the society.
