厦门市建设工程招标投标改革实践

摘要
“最低价中标法”是国际通行的工程项目评标原则,其“公开、公平、公正”和“充分竞争”的特性,对于优化资源配置,形成优胜劣汰的市场机制,进而保障建设行业健康发展具有重要的作用。它已经成为我国建设工程招投标的发展方向。随着市场经济的持续发展和建筑市场改革进一步深入,厦门市于全国率先实施“最低价中标法”,这既是对厦门市近20余年招投标制度与时俱进的重大改革,也是厦门市建设工程招标投标迈向国际化的重要一步。但由于机制不完善,法制不健全等原因,厦门市在实施“最低价中标法”的过程中出现了不少问题。因此,在弄清国内外建设工程招标投标差异的基础上,对上述问题进行充分的调查、分析、研究和论证,对于规范化厦门市建设工程招标投标工作,有效推行“最低价中标法”具有重要的意义。
本文写作框架分为四个部分:
第一部分介绍了厦门市建设工程招标投标改革发展的三个阶段—初步建立阶段、规范发展阶段和不断完善阶段,并论述了国外发达国家招标投标的制度框架、运行特征和发展趋势,以供参考。
第二部分从现状分析着笔,探究出厦门市建设工程招标投标的改革实践中出现的问题以及其产生的原因和影响因素。
第三部分则是深化招标投标改革加强有形建筑市场建设的基本思路和主要措施,提出解决目前厦门市建设工程招标投标中存在问题的方法和政策建议。
第四部分围绕着如何实施“最低价中标法”和如何实施好“最低价中标法”这两个问题,对厦门市建设工程“最低价中标法”的实践完善进行分析探讨。
The Lowest price Bid Law is the usual evaluation standard in the international construction engineering.Its characteristic is open、justice and equity ,which is particular important to optimize resource disposition,form the market mechanism of the survival of the fittest,and then ensure the well development in the construction industry.The Lowest price Bid Law has been the direction in the development of Construction Engineering Project Bidding.
As the durative development of the market economy and the deep reform in the constrcution market,Xiamen has taken the lead in operating the Lowest price Bid Law,which has been not only important reform in the system of tendering of Xiamen in recently 20 years,but also significant to catch up with the step of the international practice.However,there are still many questions in the process of operating the Lowest price Bid Law because of the imperfect in the area of mechanism and the distemperedness in the filed of legal system.Thus,to investigate、analyse、research and argue those questions is significant to standardize the Construction Engineering Project Bidding ,and to push the Lowest price Bid Law effectively,which especially base on making clear the difference of Construction Engineering Project Bidding inside and outside China.
The article is divided into four parts.In the first place,it introduces three stagements of the reform development of the Construction Engineering Project Bidding in Xiamen,and dissertate the system、operting characteristic and the development trend of the developed countries,which can provide the mode to our country.In the second place,through the analysis of the actuality,we can explore the problems appeared in the reform . In the third place,the method is brought forward to solve the problems ,and the policy is advised, too. In the fourth place,the paper analysisi how to operate the Lowest price Bid Law and how to do it well,moreover,it discusses the practice of the Lowest price Bid Law in Xiamen.
