自然资源治理的法理逻辑辨析

摘要
推进生态文明体制改革需要建立完善的自然资源治理体系。本文从法理的视角分析了我国传统自然资源治理中存在的问题,提出建立和完善由政府、市场和社会共同参与的多元治理体系,实现自然资源国家所有权到社会主体资源使用权的传导,加强资源治理的系统性、完整性、多元性,更好发挥自然资源的经济价值、生态价值和社会价值。
Promoting the reform of the ecological civilization system requires the establishment of a perfect natural resource management system. This paper analyzes the problems existing in the traditional natural resources governance in China from Jurisprudence's point of view, and proposes to establish and improve the multi-governance system involving the government, the market and the society, to realize the transmission of the ownership of natural resources to the use of resources of social subjects, strengthen the systemic, complete and diverse nature of resource governance,and give full play to the economic, ecological and social values of natural resources.
