海南中国特色自由贸易港建设的法治创新与立法保障

摘要
习近平总书记"4. 13"讲话和中央"12号文"都提出在海南探索建立中国特色自由贸易港。而在海南建设中国特色自由贸易港的过程中,必须注重法治,强调法治的规范、引领和保障作用。借鉴其他地区成熟的自由贸易港例如香港、新加坡、迪拜的建设经验,同时充分体现中国特色、考虑海南实际,对标国际最高标准,构建统一完备的自由贸易港法律促进体系,打造法治化、国际化、便利化的营商环境,充分利用特区立法权和地方立法权,健全海南建设中国特色自由贸易港的法律规范体系,建立与国际贸易规则体系相适应的多元化商事纠纷解决机制。
Both General Secretary Xi Jingping in his"April 13 speech"and the"No. 12 th document"by the CPC Central Committee and the State Council have proposed establishing a free trade port with Chinese characteristics in Hainan Province. The rule of law and its regulating,guiding,and guaranteeing role must be emphasized in the process of building the port. While using the successful experiences of other free trade ports such as those in Hong Kong,Singapore,and Dubai,the construction of the Hainan port must also reflect its Chinese characteristics and the local conditions;the port must aim at the highest international standard,establish a unified and complete legal promoting system,and create a rule-governed,internationalized,and convenient business environment;Hainan Province must make full use of its local and specialzone legislative powers to improve its legal regulating system for the port and establish a diversified commercial dispute resolution mechanism corresponding to the system of international trade rules.
