摘要
本文主要从平等保护的角度来研究集体土地流转问题。在集体土地流转上，农民土地权益主要受到来自地方政府低价征收和农民集体截留土地增值收益两个层面上的侵害。来自农民集体的侵害属于农民集体内部的结构治理问题，可以通过完善村民自治制度和集体资产产权制度创新来解决，本文对此进行了探讨。但本文的研究重点主要放在政府征收与农民土地流转的权益保护上。
本文的研究主要以湖北省为案例，以耕地面积和土地出让金的变化来衡量农民土地权益的受损情况，所有分析数据主要来自湖北省各年的统计年鉴、国土资源年报以及问卷调查。全文共分九章，按照“集体土地流转现状—实证分析—田野调查—根源探究—实践探索—发达国家经验借鉴—制度体系设计”的逻辑思路展开。绪论主要介绍研究背景、国内外研究现状及主要创新点；第二章主要通过分析集体土地利用现状来说明土地流转状况；第三章主要对集体土地流转中的农民权益受损情况进行实证分析；第四章则对对集体土地流转中的农民权益受损情况进行田野调查；第五章在前文对湖北省分析的基础上，运用全国的统计数据再次分析耕地面积与土地出让金之间的反向变动关系，探究农民土地权益受损的宪法根源；第六章研究集体土地流转制度改革的探索尝试及政策法律障碍；第七章从土地发展权的角度介绍发达国家平等保护土地流转双方权益的成功经验；第八章结合我国实际提出了基于农民权益保护的农村集体土地流转制度体系设计的基本思路；第九章总结全文，指出不足及进一步努力的方向。全文的创新点主要有：
1．研究视角的创新：本文主要从“资源—资产”视角来探讨土地流转中农民权益的平等保护。将集体土地作为资源或生产要素需要自由流转的角度研究土地流转，有助于促进市场在要素配置上起基础性作用；将集体土地作为资产需要平等保护的角度来研究土地流转，有助于农民集体成为土地市场上新的供给者，打破国家对土地市场的垄断。
2．研究方法的创新：本文运用计量分析法研究湖北省土地利用的结构变动以及湖北省农民土地权益受损情况。研究该省土地流转的相关文献，还没有文献使用这种方法。
3．研究结论的创新：一是农民土地权益难以得到平等保护的根源在于宪法第十条中城市土地归国家所有与第十二条中公有财产神圣不可侵犯之间存在矛盾的观点；二是基于平等保护的农民集体土地流转制度体系设计中提出的可操作性的政策建议。
Based on the notion of equal protection, this thesis mainly studies issues concerningcollectively-owned land transfer. In the course of the transfer, infringement to farmers' rightsand interests mainly results from undervalued land requisition by local government andretention of land added value return by the collective. This thesis attributes the latter to thecollective's internal governance and suggests solutions by the perfection of theself-governance system in the rural area and innovation of the collective property regime. Yet,the focus of this thesis is mainly on land requisition by local government and protection offarmers' rights and interests in the course of land requisition.
This thesis mainly analyses the changes of cultivated land area and land-transferring feesin Hubei Province. Relative data are from the province's statistical yearbooks and annualreports of land and resources, and questionnaires. The thesis contains nine chapters under theguidance of the logic line of the status quo of collective land transfer - empirical analysis -field survey - exploration of root causes - practice research - analysis of experiences fromdeveloped countries - suggestions on institutional system. The first chapter makes anintroduction to the background of the thesis, current research status at home and abroad, andthe main innovations of this thesis. The second chapter explores the current situation of landtransfer by analyzing the present situation of land utilization. The third chapter carries out anempirical analysis of the infringement of farmers' rights and interests in the course of landtransfer. The next chapter makes a field survey in this regard. Based on the previous analysisof Hubei Province's condition, the fifth chapter reveals the reverse change relationshipbetween cultivated land area and land-transferring fees by analyzing relative national data andexplores regulations in the Constitution leading to the damage to farmers' land rights andinterests. Chapter Six discusses reforms of the collectively-owned land transfer regime andpolicy and legal obstacles. From the perspective of land development right, Chapter Sevenintroduces developed countries' experiences in offering equal protection to parties to landtransfer transactions. Chapter Eight puts forward proposals on rural collectively-owned landtransfer regime with the orientation to protect farmers' rights and interests in accordance with China's realities. The last chapter draws a conclusion as well as points out some flaws in thethesis and the direction of future research.
Innovations of this thesis include:
1. Perspective of research. From the perspective of "resource - asset", this thesis inquiresinto approaches to offer equal protection to farmers in the course of land transfer. This thesistreats collectively-owned land as resources or factor of production. Treated as such, itsunrestricted transfer will enable the market to play the basic role in allocating factors ofproduction, and the necessity to offer it equal protection will make farmers suppliers in theland market, thus breaking the monopoly of the state.
2. Methodology. Clustering and econometric models are used in this thesis to analyse thechanges in land utilization and damages to farmers' land rights and interests in Hubei Province.Up to now, the two approaches have not been used in documents on land transfer in HubeiProvince.
3. Conclusions. First, for the first time, this thesis pinpoints the root cause why farmers'land rights and interests can not enjoy equal protection -- conflicts between Article 10 andArticle 12 of China's Constitution. Article 10 says that land in urban area belongs to the stateand Article 12 says that public property is sacred and inviolable. And second, innovativepolicy proposals are put forward in terms of equally protecting farmers' rights and interests inthe process of land transfer.
