摘要

采用文献资料等研究方法对政府购买体育公共服务法律进行分析,认为政府购买体育公共服务已成为政府职能转变的重要手段,但相关法律的缺陷势必阻碍政府购买体育公共服务的深入推进。现阶段政府购买体育公共服务法律存在的缺陷主要有政府购买体育公共服务法律法规还不完善、政府购买体育公共服务相关信息未实现真正透明、政府购买体育公共服务绩效评估机制还未建立,监督机制还未健全、政府购买体育公共服务市场准入制度还未建立、体育公共服务政府购买程序与购买合同还需公允和规范。政府购买体育公共服务制度设计包括中央与地方加强法律法规建设与制定和完善相关配套制度,需制定和不断完善信息制度、监管与问责制度、评估制度、契约合作和法律救济机制等。
        Using the methods of literature material to analyze the government buy sports public service law,thinks the government buy sports public service has become an important means of government function transformation,but the defects of relevant laws will inevitably hinder the government buy sports public service deepened. At present stage the flaws of the government buy sports public service law mainly has the government buy sports laws and regulations of public service is not perfect, the government buy sports public service information unrealized truly transparent,the government buy sports public service has not yet established performance evaluation mechanism,supervision mechanism is not perfect,the government buy sports public service market access system has not been established,sports public service government purchase process and purchase contract is subject to fair and specifications. The government buy sports public service system design including the central and local to strengthen the construction of laws and regulations and to establish and to perfect the related system,needs to develop and constantly improve the system of information,supervision and accountability system,assessment system,contractual and legal relief mechanism.
