区块链新闻平台内容生产的法律规制研究

摘要
目前我国对区块链技术的研讨方兴未艾,借助其技术优势以及新闻业数字化转型升级的现实需求,区块链新闻平台应运而生。区块链新闻平台以"去中心化"为核心理念,是分布式网络架构、去中心化数据库、网络中立性理念共同发展的产物。在区块链新闻平台上新闻真实性审查成为众包项目,媒体或作者获取资本、结算稿酬、取得知识产权更易操作,新闻品牌、原创自媒体获得更多发展机会,但也促使新闻生产再次走向内聚。从全球区块链新闻平台的整体发展状况来看,区块链底层技术在新闻平台的应用尚不成熟,在新闻生产各面向暴露出的问题也日渐突出。为此,我国法律需从平台代币和网络运营者两方面对平台进行监管,同时鼓励平台自治,指引其在法治框架下合规发展。
At present,the research on blockchain technology is developing rapidly in China,and many blockchain news platforms are developing with the help of technological superiority of blockchain technology,and the opportunities of digital transformation and upgrading of news industry. The blockchain news platform takes "de-centralization"as its core concept,and it's the product of the joint development of distributed network architecture,de-centralized database and net neutrality concepts. Under the drive of blockchain technology,news authenticity review has become a crowdsourcing project,and the media or authors would obtain capital,settlement remuneration and intellectual property rights more easily. News Brands and We-Media have more opportunities for development,but it also promotes news production moving towards cohesion again. Judging by the development of the global blockchain news platform,the application of the bottom technology is still immature and the problems in all aspects of news production are increasingly appearing. Therefore,the law should encourage platform's autonomy and supervise the tokens and the network operators,guiding its compliance development under the framework of the law.
