摘要
自然资源是大自然赋予人类和共存生物的共有财富与生存根本,必须体现公有、公用和共享的原则。这也符合社会主义制度下"公有财产神圣不可侵犯"的宪法精神。无偿占有和消耗自然资源不仅是极不公平的违宪行为,也是损害国之根本的,对于人均资源极其短缺的我国尤其如此。制定严格、完备和可靠的自然资源占用与消耗补偿制度,是唯一可行的制度措施,也是立法的当务之急。以其他调节措施代替则是舍本求末。
        Natural resources are the common wealth and the key to survival which nature endows humans and coexisting organisms, it must reflect the principles of public ownership, publicity and sharing. It is also in line with the constitutional spirit of "public property is sacredly inviolable" under the socialist system. The free possession and the consumption of natural resources is not only a very unfair and unconstitutional act, but also a fundamental damage to the country, especially for our country which suffers inadequate pre-capita shortage of resources. The only feasible and institutional measure is to formulate a strict, complete and reliable compensation system for the occupation and consumption of natural resources, it is also a top priority for legislation. While using other adjustment measures replaces compensation and consumption system of natural resources is putting the cart before the horse.
