基于教义学体系变革的行政法政策学的确立和构建

摘要
今天的行政法学正在历经一个体系变革的时代,基于行政任务达成的目标和政策法律化的现实,行政法学应当从行政的本质出发,借鉴公共政策学的分析框架,确立法政策学的研究,以实现行政作为政策目标的合目的性和作为法的合法性。行政法政策学的确立是回应行政现实的需要,其构建需要处理好与行政法解释学、既有的行政法立法论的关系,实现法律内的政策考量,从而在坚持行政法教义学立场的基础上,回应行政现实的变迁,更好地实现行政法治的理想。
Today administrative law is undergoing an era of system reform. Based on the realization of administrative tasks and the legalization of policies, administrative law should proceed from the essence of administration, draw on the analytical framework of public policy, and establish the study of legal policy, which helps to achieve the purpose of administration as a policy goal and the legitimacy of the law. The establishment of legal policy theory is in response to the need of administrative reality. Its construction needs to deal with the relationship between administrative law hermeneutics and the existing administrative law legislation, realize the policy considerations within the law, and thus adhere to the basis of the administrative law dogmatics standpoint. This helps to response to change of administrative reality and realize the ideal of administrative rule of law.
