重大行政决策程序法律规制实践中的问题与对策

摘要
重大行政决策程序规制已是行政决策法律规制的共识,但其涉及的若干实体问题在理论界和实务界则始终存在较大争议。重大行政决策作为不确定法律概念,与一般行政决策、规范性文件等概念极易混淆,需要厘清。实务操作层面,如何处理政府重大行政决策与部门重大行政决策之间,上下级政府重大行政决策之间,决策公开与信息公开之间,决策合法性评估与合法性审查等几个关系都是亟待解决的现实问题。系统梳理和分析问题,对于完善重大行政决策程序规范、健全相关决策程序机制具有重要的理论意义和现实意义。
The procedure regulation has been the consensus of legal regulation to major administrative decisionmaking,but a number of substantial issues are still controversial,such as the major administrative decision-making,as an uncertain legal concept,is easily confused with general administrative decision-making and normative documents,which needs to be clarified.In practice,there are several problems which are of great significance to improve decision-making process and related mechanism,includinghow to deal with the relationship between the government’s and its department’s decision-making,the relationship of administrative decisions between higher and lower levels,the relationship between decision-making publicity and information publicity,the relationship between legitimacy evaluation and legitimacy review etc,.
