摘要

我国与法律相关的制度、体系、习惯、意识等形成了独具特色的传统法律文化,传统法律文化以集团为本位,注重礼法融合,具有浓厚的伦理色彩,无讼理念根深蒂固,且重视情理,除此之外传统法律司法行政不分。随着改革开放,我国在法制现代化的道路上一面受西方法律文化的冲击,一面受传统法律文化的影响,法律观念有一定的滞后性,因此在现代化推进道路上存在一定阻碍。传统法律文化的和谐理念为构建社会主义和谐社会奠定了价值基础。
        China's legal-related systems, systems, habits and awareness have formed a unique traditional legal culture. The traditional legal culture is based on the group, pays attention to the integration of etiquette and law, has a strong ethical color, the concept of non-litigation is deep-rooted, and attaches importance to reason. In addition, the traditional legal and judicial administration is indiscriminate. With the reform and opening-up, our country is impacted by the western legal culture on the road of legal modernization, and influenced by the traditional legal culture on the one hand,the legal concept has a certain lag, so there are some obstacles on the road of modernization. The harmonious concept of traditional legal culture has laid a value foundation for building a harmonious socialist society.
