建设工程合同管理绩效评价与分析

摘要
举世瞩目的三峡工程从梦想变成了现实,这一凝结了无数中国人心血和智慧的跨世纪宏伟工程在极大地丰富了中国人民的物质财富的同时,也给我们炎黄子孙留下了不可磨灭的精神食粮。
     三峡工程合同管理,以其规范的运作、严格的管理和难以替代的作用,极大地促进了三峡枢纽工程建设和百万移民安置的顺利进行,为三峡库区的经济发展和社会进步做出了重大贡献;对新形势下国家投资兴建大型工程项目发挥监督管理作用进行了有益的探索和尝试,对我国建设工程管理体制机制的建立和发展进行了改革和创新,有力促进了我国建筑市场的健康发展。但由于我国社会经济的历史背景和发展环境的特殊性,建筑行业的发展还处于初级阶段,各种政策、制度和措施还需要进一步完善,尤其是以合同管理为标志的建筑市场经济体制建设更不是一朝一夕能够完成的,需要做出长期艰苦的努力。
     建设工程合同管理绩效评价就是促使建筑市场发展和完善的一种有力工具,它从建设工程的可行性研究(或招投标)阶段开始,历经工程建设的各个重要环节,对工程建设项目的招标投标、勘察设计、施工、生产等各个阶段以及参与工程建设的各方,包括业主、承包商、勘察设计、监理咨询、银行、保险、交通运输、卫生检疫、政府部门甚至于群众个人等各个主体的工作成效进行科学、客观、公正的评价和分析,协调、指挥、处理工程建设各个阶段中出现的重大经济、技术问题,调解、仲裁各种纠纷,化解矛盾,提高效率,是提高我国工程建设项目管理水平的重要推手。
     本文通过对众多三峡工程合同管理文件内容的分析,从合同管理组织的结果绩效和行为绩效两方面入手,着重从以下几个方面进行了独创性研究和探索:
     1.借鉴、融合企业管理绩效评价和项目评价的有关思想、理论和方法,在广泛调查研究和专家咨询的基础上,把绩效评价方法首次运用于考核和评价三峡工程合同管理效果的实践,扩展和延伸了绩效评价的应用范围;
     2.建立了三峡工程合同管理绩效评价指标体系,构建了实用的绩效评价模型,对三峡工程众多合同管理文件的绩效进行评价和分析,取得了极其丰富和宝贵的第一手资料,为三峡后续工程建设和其它大中型工程项目建设提供了有益的经验和借鉴;
     3.提出了我国建设工程合同管理绩效评价的最高目标和现阶段的操作思路,并付诸于三峡工程的建设实践,为下一步建立更大范围的建设工程合同管理绩效评价系统和整个建筑行业的合同管理绩效评价体系打下坚实的基础;
     4.制定、增加、修改、补充和完善了部分合同范本的条款,使之更适合于我国工程建设管理的实际情况,改变了我国工程建设合同管理主要参照和沿用国外示范文本的做法;
     5.从经济学、管理学等理论高度对三峡工程合同管理绩效评价活动进行了总结,对合同管理绩效评价今后的发展方向进行了展望和思考,并提出了一些有参考价值的意见和建议。
The Three Gorges Project had become reality from a fond dream with attracting worldwide attention. It has congealed painstaking effort and wisdom of uncounted Chinese which had done across trans-century, it has enriched material wealth of the Chinese People, also give us all Chinese descent left the indelible mental nourishment.
     The Three Gorges Project contract manages, because it's standard operation , strict administration and bige effect with being difficult to replace, has boosted proceed as planned of Three Gorges key position engineering construction and million immigrants arrange for being in progress, has made major contribution out for Three Gorges Project construction and carried out the beneficial exploration and trial to the new circumstances for government investment builds the large-scale construction project bringing the supervision administration effect into playing. It has developed reformation and innovation for our construction project manages machine-made building-up of system. But because of background of our social, economic, and historical background, and special development condition, the development and improvement of the construction industry needs time, investment and social joint care, especially the institution marked by contract management for the construction market marked cannot be completed overnight and require the efforts of all society.
     The performance evaluation of construction contract management is one of the powerful tools to promote the development and improvement of the construction market, It begins from construction project feasibility study (or tender) stage of engineering construction, Get through one by one important engineering construction stage, It including the invitation to bid to engineering construction project bids , surveys design, each stages such as being under construction and the proprietor who participates in engineering construction, contracts business, inspection and control consults, bank , insurance , traffic , checkout quarantine and government departments etc carry out an objective , estimate that and analyse impartially, Harmonize , command the significant economy , technology problem appearing in each stages of engineering construction , handle, Mediate, arbitrate the various dispute, resolve contradiction, the potentiation, as an important handle to increase the level of engineering construction management.
     The book has analyed lot of content's to Three Gorges Project contract, it starts from two approaches included the result performance and behavioral performance in contract management organization, it emphasized the research and exploration having carried out originality from several the following aspect:
     1.It has borrowed some ideas and theories and methods referring to business management performance evaluation and project evaluation, has used it to the Three Gorges Project first which hae based lot of investigation and study and consulting expert in broad, had expanded sum stretching imitates the application range.
     2.It has built a first step manages the achievement effect appraising index system to The Three Gorges Project, had selected mature and practical method of performance evaluation to analyze and evaluate part of performances of the construction contract management in The Three Gorges Project, had got the extremely rich and precious firsthand data, had provided valuable experience to follow-up engineering construction of Three Gorges and other big medium-sized construction projects.
     3.It has suggested the maximal target that our country construction project contract manages and the operation thought of present stage and put it into the construction practice in Three Gorges Project, and lay a solid foundation for establishing a wider range of contract management performance evaluation system in construction engineering and construction industry in the next step.
     4.It had creased and revised part contract terms, maken it has been more suitable to our country project builds administrative reality, changed our country engineering construction contract administration continued to use abroad version mainly.
     5.It has carried out a summary to Three Gorges Project from theory altitude such as economics and Management, It has imitated the direction of the contract manages performance evaluation and has suggested that some idea and suggestion to future.
