区域突发公共事件应急联动体系研究

摘要
进入21世纪以来,各种突发公共事件爆发频率急剧上升,一些突发事件波及的范围具有典型的跨行政区划的区域性特征,这些区域在空间覆盖范围上与行政区域有错位与重合,这就需要构建区域突发公共事件应急联动体系,有效利用不同地区、部门的社会资源实施救援,使突发事件带来的损失减到最小。
     一个高效能的区域突发公共事件应急联动体系应包括完善的组织架构、缜密的预测预警机制、快速的应急联动机制、合理的应急联动资源储备利用等方面。本文以此为主线展开研究,全文共分五部分,第一部分绪论,内容包括第一章;第二部分区域突发公共事件应急联动体系的构建及运行机理、机制分析,内容包括第二、三、四、五、六章;第三部分区域突发公共事件应急联动体系的法律保障及能力评价,内容包括第七、八章;第四部分实证分析,内容包括第九章;第五部分全文总结,内容包括第十章。
     本文根据区域突发公共事件的特征,将区域应急联动组织设计为网络式动态联动组织。它是以政府应急管理法律法规为基础建立的动态连接体,以突发事件的类型和级别作为任务的结合点,常态下各联动单位根据自己本单位职责对突发事件进行预测预控,非常态下对突发事件应急处置快速响应。区域突发公共事件应急联动体系是一个开放的、具有非线性特征的、包含许多小系统的复杂系统,它的运行遵循协同学规律。
     区域突发事件预警机制运作的基本原理是,预警管理人员依照预警目标确定不同预警监测指标,确定预警监测指标的标准,并用这些标准对预警管理对象实施控制。它包括对突发事件的监测预控、分类分级以及应急预案的制定等内容。区域突发事件应急联动是政府将所有资源纳入到一个统一的指挥调度系统,协调指挥各相关部门,向社会公众提供紧急救助服务的联合行动。应急联动机制的运作程序包括接警、对突发事件等级的识别、召开对策会议、启动应急联动程序、对事件现场状态和潜在危害的监测和评估、善后处理和恢复重建。区域突发公共事件应急资源的储备,是实施紧急救助、安置灾民的基础和保障。在应急管理中必须将资源共享与信息共享的区域应急管理模式有机地集成在一起,形成以信息化和资源化为特征的纵横交错的区域应急联动资源配置网络结构。
     在现代法治社会中,加强对政府应急管理的理论研究和制度建设,首先要从法治原则的要求出发,将政府应急管理严格地限制在法治行政的范围之内来加以讨论。
     区域应急管理能力主要应该包括四个方面,即社会控制能力、行为反应能力、安全技术能力和紧急救援能力。建立科学的评价指标体系及其模型,就能对其进行全面的、综合的反映和描述。
     本文以三峡库区为例,对区域突发公共事件应急联动体系的构建进行了实证分析。三峡库区是以大型水利枢纽为特征的跨行政区的区域,本文提出(1)成立基于政府管理的三峡库区突发事件预警联动中心。其联动范围包括整个三峡库区,实行跨省联动,库区中心下设二个分中心,分中心一管理库区重庆地段,分中心二管理库区湖北宜昌地段。(2)成立基于政府指导的三峡库区非政府公共服务组织。将库区两边岸线划分为若干个社区,社区中的机关、企业、居民区均为该组织联动单位。本文还对三峡库区预警应急联动机制、应急资源管理机制等进行了分析。
Since 21st century frequency of all sorts of public emergency bursting has rapidlyrisen, range of some emergency which involved has typical regional characterstic oftransregion. The space range of these regions have malposition and coincide withdistricts. Urgent joint action system for public emergency in region need be composed,in order that social resources of different districts and departments will be made gooduse of to carry out rescue and damages that emergency brings will be decreasedminimum.
     A good efficacy urgent joint action system for public emergency in region shouldinclude perfect organization frame、meticulous calculate and early-warningmechanism、rapid urgent joint action mechanism、reasonable urgent joint actionresources store and use and so on. The dissertation takes this as main thinking andbegins research. The whole dissertation is divided five sections. The first section isintroduction, which content includes the first chapter; the second section iscomposition of urgent joint action system for public emergency in region and analyseof operation mechanism, which content includes the second、the third、the fourth、thefifth and the sixth chapter; the third section is law guarantee and ability evaluate ofurgent joint action system for public emergency in region, which content includes theseventh、the eighth chapter; the fourth section is positive analyse, which contentincludes the nineth chapter; the fifth section is summings-up, which content includesthe tenth.
     The dissertation considers urgent joint action organization in region should bedesigned dynamics joint action organization of network style according to regionalcharacterstic of emergency. It is a dynamics joint body on the basis of emergencymanagement law of government, and it takes the kind and scale of emergent as jointpoint of assignment. Each joint action unit calculates and forecasts emergency in thelight of obligation itself under normality, and they will rapidly respond to emergencymanagement under unusual condition. Urgent joint action system for publicemergency in region is an open complicated social huge system with non-liner featurethat includes many small systems, and its operation follows synergetics law.
     The basis operating principle of public emergent early-warning mechanism inregion is that early-warning managers determine different early-warning monitortargets and standard in the light of early-warning objective and take use of these standards to get under control early-warning management targets. It includes tomonitor and control in advance against emergency、classify and grade of emergencyand to designs emergent advance case. Urgent joint action against public emergencyin region is that government brings all emergent resources into a united commanddispatch system, coordinates to command every related department, provides jointaction of emergent succor service for social public. The operating procedures ofemergent joint action mechanism include to receive alarm、to discriminate emergencygrade、to convene countermeasure meeting、to start emergent joint action procedure、to monitor and evaluate scene and hidden harm、to cope with the aftermath、to resumereconstruction. The store of emergent resources against emergency in region is basisand guarantee to put into effect emergent succor and settle victims. Emergencymanagement must gather organically resource share model of regional emergencymanagement with information share and form a crisscross network of regionalemergent resource disposition with information and resource characterstic.
     In modern rule by law society, to strengthen theory research and institutionconstruction to government emergency management should begin with the request ofrule by law first, which discusses government emergency management within thestrict confines of administration rule by law.
     Regional emergency management ability should mainly include four aspects, thatis to say, social control ability、behavior reaction ability、secure technology ability andemergent succor ability. To set up science evaluation targets system and model isoverall to reflect and describe certain regional emergency management ability in thelight of evaluation model.
     The dissertation positively analyses construction of urgent joint action systemagainst public emergency in region example for Three-Gorges reservoir region.Three-Gorges reservoir region is transregion with large-scale water conservancy pivotcharacteristic. The dissertation considers: (1) to establish the early-warning urgentjoint action center against emergency in Three- Gorges reservoir region ongovernment management. Its joint action region includes whole Three-Gorgesreservoir region to perform trans-province joint action. The center sets up twobranches: one manages Chongqin sector of Three-Gorges reservoir, the other managesHu Bei Province Yichang sector of Three-Gorges; (2) to establish non-governmentpublic service organization in Three-Gorges reservoir on government guidance. Twosides of water front will be divided into a number of social sectors, in which government organization、enterprises and residential areas arc joint action units of theorganization. The paper also analyses the early-warning emergent joint actionmechanism and the emergent resource management mechanism in Three-Gorgesreservoir region.
