我国政府信息公开制度研究

摘要
政府信息公开是现代民主理论和基本人权理论发展的结果。它确立了国家权力的公开运行模式,实现了公民对公共事务的知情权,更为民主行政、参政议政、监督行政提供了制度保障。政府信息公开不但具有重要的政治意义,本身也具有很重要的经济意义。据统计,政府掌握了大约80%以上的信息资源。政府拥有的信息资源是知识经济时代的重要资源,是推进经济社会进步的不可或缺的条件。为使这些资源能够真正发挥作用,提高社会资源的配置水平和政府的工作效能,就必须大力推进政府信息的公开与共享。随着我国社会主义法治国家建设的进一步加快和加入世界贸易组织后参与国际竞争的需要,尽快与社会主义市场经济体制相适应的统一完善的政府信息公开的法律保障制度已迫在眉睫。
至全力推行政府信息公开以来,各地区各部门按照中央的要求,结合实际,狠抓落实,全国政务公开工作取得了明显的成效,成为我国政治体制改革,民主与法治建设中的一大进步。各级政务部门利用信息技术,扩大信息公开,促进信息资源共享,推进政务协同,政务信息资源建设和服务取得成效,提高了行政效率,改善了公共服务,有效推动了政府职能转变。我国政府信息公开的制度建设和法制建设虽然有一定的发展,但仍处于探索阶段,政府信息公开还存在很多问题。如:公民信息公开意识薄弱、政府机关的服务意识淡薄、信息沟通渠道不畅通、监督和协调机制不健全、信息公开制度缺少立法支持、信息公开以权力为基础等。因此,我国政府信息公开的发展需要在理论上进行新的探索,并用新的理论来指导政府信息公开实践活动的进一步发展。
本文通过对政务信息公开理论的探讨,结合我国政府信息公开的现状,借鉴各国有益的经验,提出构建我国政府信息公开的基本对策。
The publicity of government information is the result of the development of modern theory of democracy and the theory of basal human-rights. It establishes an open moving pattern of national power and makes the right to know be come true .even more it provides Protection system for democratic administration, citizens supervising and participating in administration and Administrative supervision. Government information has important political significance and Economic Significance. According to the statistics, the government controls the information resources approximately above 80%. The information resources that the government owns are important resources in the era of knowledge economy, and are indispensable conditions to Promote economic and social progress. In order to these resources can really play a role, and increase the allocation of social resources and enhance the effectiveness of the work, we must vigorously promote the information public. In the demand of building our socialistic country ruled by law and participating in international competition, we should establish the system of government information publicity As soon as possible.
With the implementation of the Government Information publicity, In accordance with the requirements of the government, various regions and various departments Contact reality and firmly implement, then the administration made marked achievements, it becomes a major bright spot in China's political system reform, democracy and the rule of law. Administrative departments at all levels use the information technology, expand information publicity, promote the sharing of information resources, promote Chief synergy, improve administrative efficiency, improved public services and effectively promote the transformation of government functions. The Government information publicity has many issues. Such as: government agencies have a weak sense of service, monitoring and coordination mechanism is not sound, the lack of information legislation to support the open system and so on. Therefore, the government information publicity needs new theories to guide the practice for the further development.
Based on the theory of the government information publicity, According to the status of publicity, Draw on the useful experience of the other countries, the paper pointed out the Government Information publicity’s lack of in legislation and practice, and then gets Countermeasures to construct of the system of government information publicity.
