信息公开制度研究

摘要
信息公开是现代民主国家一项基本法律制度。第二次世界大战以来，随着社会经济的发展和民主、权利意识的增强，以及信息社会的到来，信息公开成为世界范围内的潮流，世界各国掀起了信息公开立法的高潮。本文在对各国信息公开法律分析的基础上，试图从民主政治、社会经济、信息社会等多角度，并以权利义务观念、法治观念、服务与合作观念、信息观念来论述信息公开的基本理论、基本内容、保障和救济，分析我国信息公开的现状及存在的问题，并提出展望。
全文分为四部分：
第一部分论述了信息公开制度的基本理论。主要分析了信息公开产生的民主法治背景、社会经济背景、信息社会背景，介绍了各国信息公开的状况，分析了信息公开的发展趋势，阐述了信息公开的涵义、特征、价值，论述了信息公开的宪法基础、法理基础和行政法基础。
第二部分阐述了信息公开的基本内容。主要阐述了信息公开的义务主体、权利主体、第三人及其权利和义务，提出并分析了信息公开的六项基本原则，阐述了信息公开与不公开范围的划定，设定了信息公开的程序。
第三部分论述了信息公开的保障和救济。探讨了信息公开的保障措施，分析了信息公开救济的类型和途径。
第四部分分析了国信息公开的现状及存在的问题，并提出对策和展望。
Information publicity is a basic legal system. Since the World War II. With the development of social economy, the consciousness enhancement of democracy and right, the advent of information society, information publicity has become a worldwide tendency and there is a heat of the legislation of information publicity all over the world. On the basic analysis on systems of Information publicity of different countries, from several point of views such as democracy, social economy, information society, the thesis tried to analysis the status quo, point out the problem involved, and give an expectation on information publicity of China.
The thesis is divided into four parts:
Part 1 discusses the basic theory of the system of information publicity. Discussing mainly the social setting of democracy, economy and information; introducing the instance of information publicity of different countries; discussing the tendency of information publicity; expounding the meaning, the character and the value of information publicity; discussing the theoretical basis of constitutionalism, the theoretical basis of theory of law, and the theoretical basis of administrative law.
Part 2 expounds the basic content of information publicity. Expounding mainly the right subject, the obligation subject and the third party of information publicity; expounding the right and the obligation of information publicity; pointing out six basic principles of information publicity; expounding the scope of public information and nonpublic information; designing the procedure in information publicity.
Part 3 discusses the guarantee system of information publicity, the remedy sort and the remedy approach of information publicity.
Part 4 point out the situation and the problem of information publicity in China, and put forward the countermeasure.
全文分为四部分：
第一部分论述了信息公开制度的基本理论。主要分析了信息公开产生的民主法治背景、社会经济背景、信息社会背景，介绍了各国信息公开的状况，分析了信息公开的发展趋势，阐述了信息公开的涵义、特征、价值，论述了信息公开的宪法基础、法理基础和行政法基础。
