摘要

本文通过对我国大陆地区的黑社会(性质)犯罪和境外黑社会犯罪的初步研究，形成了对黑社会(性质)犯罪问题的粗浅看法。现将本文主要内容介绍如下：
     本文前言部分，介绍了选题的目的、意义和研究方法。
     第一部分主要介绍了大陆地区黑社会(性质)犯罪的历史、现状与发展趋势。
     大陆地区的黑社会(性质)犯罪，虽然没有形成传统意义上的典型的黑社会犯罪，但是，随着它的进一步发展和蔓延，加上许多负面因素的影响，它正在向政治、经济和国际领域扩张。
     第二部分探讨了黑社会(性质)犯罪的概念、特征和类型。
     所谓黑社会(性质)组织，指以暴力、威胁或其他手段，在一定地域内有组织地进行违法犯罪活动，具有一定的经济势力，称霸一方，为非作恶，欺压、残害群众，严重破坏经济、社会生活秩序的犯罪组织。它具有四个特征，即组织结构、经济势力、行为方式和非法保护。
     本文从犯罪主体、客体、客观方面等论述了黑社会(性质)犯罪的法律特征。黑社会(性质)犯罪成立的首要条件是黑社会(性质)组织的存在，它有组织地进行违法犯罪活动，侵犯了社会公共秩序。
     第三部分主要阐述了我国刑法中对黑社会(性质)犯罪的界定。
     第四部分通过对国外黑社会犯罪的立法介绍，探求我国黑社会(性质)犯罪立法中存在的缺陷，最后提出了完善我国黑社会(性质)犯罪的立法建议。
The thesis has shown its views about this subject by the elementary study on the underworld-natured crime in the mainland of China and abroad. Here's a brief introduction of the thesis.
    The preface tells about the purpose, significance and study method of choosing the subject.
    The first part introduces the history, present situation and tendency of the underworld-natured crime in the mainland of China.
    The second part defines the concept* legal futures and categories of the underground-natured crime.
    The underworld-natured organization is a well-organized one to break the law and commit all sorts of crimes in some definite areas, seriously sabotages the economy and social living orders .It has four features which include organized system, economy forces, mutual activation and illegal protection.
    The thesis makes a statement about the legal futures of the underworld-natured crime from the subject, the object and the objective aspects of the crime. It indicates that the primary condition in constitution of the underworld-natured crime is that there exists the underworld-natured organization, which has sabotaged the social public order and is well-organized to break the laws and commit crimes.
    The third part tells the determination between the underworld-natured crime and the other criminal organizations.
    The fourth part introduces the legislation of the underworld crime abroad, the legal shortages of the criminal law about the underworld-natured crime in the mainland. In the end, the author puts forward the counter-measures to prevent and perfect the present underworld-natured crime in our country.
