跨域治理理论在长江流域立法中的应用

摘要
跨域治理强调凭依多元治理主体,运用整体性治理思维,形成互济合作的治理网络,借此治理跨域公共议题。而流域环境问题有跨域性,因此,可将跨域治理理论应用于流域立法。长江流域具有跨域性,且含诸多治理主体及适用综合立法模式是长江流域立法的特点,这也决定了跨域治理有应用于长江流域立法的可能。通过研究进一步提出,长江流域立法应设立多元参与、互济合作的多元共治制度体系,构建综合规划与决策的法律制度体系。
Int er-regional governance emphasized the establishment of a governance network for mutual benefit and cooperation by relying on multiple governance subjects and applying holistic governance thinking, so as to govern cross-domain social issues. The environmental problems of river basin were cross-domain, inter-regional governance can be applied to river basin legislation.The Yangtze River Basin is cross-domain, and the legislation of the Yangtze River Basin contains many governance subjects, the legislation of the Yangtze River Basin should choose the comprehensive legislative models, which determines the possibility of inter-regional governance being applied to the legislation of the Yangtze River Basin. Hence, the legislation of the Yangtze River Basin should establish a synergic governance of multiplicity system with multiple participation and mutual cooperation, and build a legal system of comprehensive planning and decision-making.
