法国PPP法制状况及对我国的启示

摘要
法国是欧洲PPP市场的领导者,最早运用PPP模式的国家之一,建立了较为完备的PPP法律体系,因而考察法国的PPP及其法制状况对我国的PPP立法及"一带一路"倡议的实现具有重要参考价值。法国PPP按运作方式的不同可分为行政长期租赁、临时占用许可、公共服务特许、公私合作合同等,但项目合同统一归属行政合同,受行政法约束。法国PPP法律框架比较复杂,包括法典、法律、法令,对不同形式的PPP均有规定,呈现国际化趋势和问题导向。法国PPP法制给我国带来的经验启示包括:重视国家统一PPP法的制定,重视合同部分条文的制定,"合法"包含合本国法、合东道国法、合国际法三个维度等。
France is the leader of the PPP market in Europe and one of the first countries to use the PPP model, and has established a relatively complete PPP legal system. Therefore, the investigation of France's PPP and legal status has important reference value for China's PPP legislation and the implementation of "One Belt and One Road"initiative. According to different operation modes, PPP in France can be divided into long-term administrative lease, temporary occupation permit, public service concession, public-private partnership contract, etc. However, project contracts are uniformly classified as administrative contracts and subject to administrative law. The legal framework of French PPP is relatively complex, including codes, laws and decrees, which have provisions for different forms of PPP, presenting an international trend and problem orientation. The experience and enlightenment brought by French PPP model to China include: attaching importance to the formulation of PPP law of national unification, attaching importance to the formulation of some provisions of the contract, and there being three dimensions in "legitimacy"including domestic law, host country law and international law.
