摘要

在评标过程中,经常出现有效投标人少于三个的情形,对此不少评标专家(包括监督部门和招标单位)都认为应重新招标,其依据主要是《政府采购法》第三十六条和《招标投标法》第二十八条的相关规定。本文对照相关法律法规条文就这个问题进行简单的法理辨析,提出处理此类问题的观点和理由,并给出了防范和改进的意见和建议,力求减少实际操作者由此产生的困惑,提高招投标工作效率。
        In the process of bid evaluation, there are often fewer than three valid bidders. Many bid evaluation experts(including supervisory departments and bidding units) think that they should be re-tendered. The basis is mainly the Government Procurement Law. Article 36 and the relevant provisions of Article 28 of the Tendering and Bidding Law.This article makes a simple legal analysis of this issue in accordance with the relevant laws and regulations, puts forward the viewpoints and reasons for dealing with such problems, and gives opinions and suggestions for prevention and improvement, striving to reduce the confusion caused by actual operators and improve the recruiting.
