摘要

本文旨在通过全面研究我国医疗责任保险发展现状,分析其在当前形势下面临的问题,从而探索出创新发展新思路。首先阐述了我国现行医疗责任保险制度的相关理念,包括其特点、立法进程及发展状况;其次研究了当前医疗责任保险制度存在的不足之处;第三总结了欧美等发达国家发展医疗责任保险的成功经验;最后在上述分析的基础上提出了可行建议,包括实行行政命令与立法保障相结合、针对诊所特设险种、各级医院实施相对应的分级费率、建立健全医疗纠纷调解机构等。
        This paper aims to explore the current situation of China's medical liability insurance, analyze its problems in the current situation, and explore new ideas for innovation and development. Firstly, this paper mainly expounds the relevant concepts of China's current medical liability insurance system, including its characteristics,legislative process and development status. Secondly, it studies the shortcomings of the current medical liability insurance system. Thirdly, it summarizes the successful experience of developing medical liability insurance in developed countries such as Europe and America. Finally, this paper puts forward feasible suggestions based on the above analysis, including the combination of administrative orders and legislative guarantees, special designed insurance for clinics, the implementation of the corresponding grading rates at all levels of hospitals, and the establishment of sound medical dispute mediation agencies,etc.
