乡村振兴战略下中国农村金融立法的完善

摘要
乡村振兴战略是贯穿于中国决胜全面建成小康社会和全面建成社会主义现代化强国全局的系统性工程,完善农村金融相关法律有助于更好地满足乡村振兴多样化的金融需求。完善政策性金融立法应当以供给侧结构性改革为主线,明确农村政策性金融机构职能,深化政策性金融与财政支农的资金整合,促进服务实体经济;完善商业金融立法应当以服务"三农"为根本,法定农村商业金融机构的社会责任,对农村土地和资产上市作出法律回应,着力深化金融改革;完善合作金融立法应当以普惠金融为理念,盘活民间金融资源,对农村合作金融组织开展业务进行统一监管,重点防控金融风险。农村金融法律的完善应当注重整体统筹,促进立法取向的协调稳定,为金融支农、服务乡村振兴提供法治保障。
The rural vitalization strategy is a systematic project that runs through securing a decisive victory in building a moderately prosperous society in all respects and making China a great modern socialist country in every dimension. The relevant laws to improve the rural finance are conducive to better meet the needs of rural revitalization and diversified financial needs. To improve policy-oriented financial sector legislation,the supply-side structural reform should be the main line. The functions of rural policy-oriented financial institutions should be clearly defined. The integration of policy-based finance and fiscal funds for agriculture should go a step further. That will help the financial system to serve the real economy better. Commercial financial legislation shall be designed to serve Agriculture,Rural Area and Farmers. The social responsibility of rural commercial financial institutions shall be put in to law. Legislation should provide guidance for rural land trading and the securitization of rural assets.The improvement of cooperative financial legislation should be based on the concept of inclusive finance. It is important to mobilize non-governmental financial resources and develop rural cooperative financial organizations. Unified regulation and supervision should be put in place to prevent and control financial risks in the rural area. The legal improvement of the rural finance should focus on integration and coordination,to promote the coordination and stability of the legislative orientation,which will provide the legal guarantee for the financial support for agriculture and rural revitalization strategy.
