国际法院查戈斯群岛咨询意见案述评

摘要
国际法院于2019年2月25日就备受关注的查戈斯群岛案发表咨询意见,认定毛里求斯的非殖民化进程未依法完成,英国对查戈斯群岛的持续管理构成了国际法上的不法行为,英国有义务尽快停止对查戈斯群岛的管理,联合国所有会员国都必须与联合国合作以完成毛里求斯的非殖民化。由于本案根源于毛里求斯和英国长期存在的领土主权争议,双边性异常明显,引发了国际社会对国际法院利用咨询程序解决诉讼案件的质疑。国际法院对诉讼案件的管辖基于国家同意的原则。分析国际法院对本案的管辖权和自由裁量权,探究在英国不同意将争议提交国际法院的情况下,本案是否存在包装双边争议案件为非殖民化案件从而绕开国家同意原则的做法,及上述做法对国际司法体制的影响。
