It is due to their infinite duration that placement in psychiatric hospitals (Article 63 of the Criminal Code) is the severest sanction under German criminal law, together with preventive detention. Growing numbers in the respective hospitals prompted the legislator to change the rules on imposing placements and on their continuation with the objective of a stronger focus on the principle of proportionality and facilitation of the release of less dangerous detainees. The article describes the modified substantive provisions as to the order and the execution of a placement sentence as well as to the termination of the placement together with the respective procedural rules. The modifications prove to be only partly “new” since the legislator has to a large extent merely confirmed that which the standing legislation of the High Courts has codified as established case law. Finally, the article examines the effects of the new legislation on the practice of expert witnesses.
