保护文化遗产之地方立法研究——对苏州市的分析

摘要
在保护文化遗产过程中,苏州市出台了多部地方性法规、若干地方政府规章。权力机关制定的地方性法规、政府制定的政府规章及非法律效力的规范性文件形成多层次的保护机制。苏州市文化遗产主要从行政、民事、刑事三个方面进行保护,其中,行政保护"一马当前",体现在保护理念上,是以政府"自上而下"的行政命令为主,但整个保护体系中,民众的参与度不够高。在有限政府的模式下,对文化遗产的保护要以政府为引导,民众为主体的理念。《立法法》修正案施行后,苏州市要对"历史文化保护"的外延与内涵深入研究,尽可能拓展其范围。苏州市要对现有的保护文化遗产的地方性法规与政府规章进行审查、清理、修改。
In the process of the protection of cultural heritage,Suzhou City,the introduction of a number of local laws and regulations,a number of local government regulations. The formulation of local laws and regulations,government regulations formulated by the government and the normative documents of non legal effect form a multi-level protection mechanism. Under the mode of limited government,the protection of cultural heritage should be guided by the government,and the concept of the people as the main body. " Legislative law" after the implementation of the amendment,Suzhou City,the " historical and cultural protection," the extension and connotation of in-depth study,as far as possible to expand its scope.Suzhou city to the existing protection of cultural heritage of local regulations and government regulations to review,clean up,modify.
