高校信息公开的法律规制逻辑——以32起高校信息公开行政诉讼案件为切入点的分析

摘要
通过对近4年32起高校信息公开行政诉讼案件的实证分析,高校信息公开存在高校与教育行政部门法律地位不清晰、公开标准不明确、申请人反复起诉等滥诉现象。高校信息公开的法律规制应当从程序与实体规制两方面入手,解决高校、教育行政主管部门的被告资格、信息类型的认定、不公开的标准以及滥诉的界定及矫正等问题。
Based on the empirical analysis of 32 cases of administrative litigation of university information disclosure in recent four years,it is found that the University Information disclosure have the following deficits,that is,the legal status of educational administrative departments is not clear,the standards of information disclosure are not explicit,and repeated sues occur.To solve those problems,the regulation should start from two aspects of procedure and entity to solve the problems like the qualification of defendants,the determination of information type,the standards of non-disclosure,and the correction of over appeal.
