反兴奋剂规则统一适用的困难和发展——加特林案的新思考

摘要
世界反兴奋剂机构成立的目的之一即统一反兴奋剂规则。通过对加特林违禁案件进行分析,引出反兴奋剂规则统一适用的困难,包括不能直接适用WADA条例、体育组织之间规则相异以及各体育组织不遵守规则。采取文献资料法和案例分析法对这些困难进行阐述和分析,并联系反兴奋剂规则的最新发展展开讨论。
The World Anti-Doping Agency(WADA)has been established to harmonize the anti-doping rules.This paper analyzed the Justin Gatlin case through literature review and case study so that the difficulties in the harmonization of anti-doping rules could be revealed.These difficulties included no direct application of the World Anti-doping Code,the contradiction of the rules of different organizations and the non-compliance of signatories.Finally,the paper introduced the newest development of the rules of the anti-doping system.
