互联网与大数据环境下的个人隐私权之争
摘要
互联网环境中,个体的数字痕迹无处不在、无时不有,过往的负面信息很容易被搜索引擎检索出来并造成影响。为保障普通民众的信息自决权,欧盟率先提出"被遗忘权",使信息主体有权要求互联网搜索服务提供商删除有关其过去的信息。但这项由隐私自主或个人信息控制权推导出来的权利,与表达自由、公共利益等基本权利存在价值冲突和对立,具体行使中存在诸多争议。大数据环境下个人隐私权保护边界的拓展,或可为此间矛盾提供缓冲。
