论行政协议司法审查之标准

摘要
对于行政协议的司法审查标准问题,理论与实务界仍存在比较大的争议。鉴于行政协议与民事协议所负载之功能以及人民法院内部在审判管辖上之分工,在行政协议的司法审查标准上,应当坚持合法性与合约性相结合,先进行合法性审查,再进行合约性审查的次序。
Since self-administrative agreement has been included in the scope of administrative litigation, disputes over administrative agreements have shown a rapid growth. As an important intermediary of mutual benefits between the administrative subject and the administrative counterpart, People's Court has experienced a lot in the judicial review of the administrative agreement in practice. However, there are still considerable disputes in the theoretical and practical circles about the standard of judicial review based on the dual attributes of administrative and contractual nature of the administrative agreement. In view of the functions of administrative agreements and civil agreements together with the division of jurisdiction within People's Courts, judicial review standards of administrative agreements should adhere to the combination of legality and contractuality, which should carry out the legality review first, and then the order of contractual review.
