我国运动员形象权商业价值开发研究

摘要
采用文献资料法等探讨运动员形象权的商业价值实现方式及其开发中存在的弊端。认为:法律法规不健全,体育制度改革滞后,政府垄断开发权等都是制约运动员形象权开发的重要因素。建议:进一步完善民法及体育法,促进体育制度改革,加快市场化改革进程是促进当前我国运动员形象权商业开发的重要举措。
In order to promote the reasonable development of the commercial value of althletes' image rights and to protect legitimate rights and interests of them, this paper discusses devlopment of althletes' image rights and its drawbacks in process of development by using literature review. There are several factors exist which restrain the development, such as deletion of laws, lag of reform in education system, as well as governmental monopoly on image rights of althletes. The solutions can be indicated as perfect Civil Law and Law of the People's Republic of China on Physical Culture and Sports, promote reform of sports system and sports marketization.
