论我国探望权制度的完善

摘要
我国2001年修订的《婚姻法》正式规定了探望权制度,但在主体范围、探望方式、非婚生子女利益保护等方面存在不足之处,在实践中纠纷得不到合理解决。本文从人权保障的角度出发,结合国内外的立法和司法实践,从扩大探望权主体范围、引入虚拟探望方式及保护非婚生子女利益等方面提出具体的建议。
China's Marriage Law, revised in 2001 formally stimulates the system of visiting rights. However, there still exist some deficiencies in certain aspects like the scope of the subject, approaches of visit and the interest protection of children born out of wedlock. And disputes in practice cannot be properly solved. From the perspective of human rights protection, the paper puts forward specific proposals on expanding the scope of visiting subjects, introducing virtual methods of visiting and protecting the interests of the children born out of wedlock with a combination of the legislative and judicial practice both at home and abroad.
