对刑事申诉公开审查工作的若干思考

摘要
刑事申诉公开审查作为深化检务公开,增强办理刑事申诉案件透明度的重要方式,有利于实现刑事申诉检察工作的公平正义,提升检察机关的执法公信力。但是目前刑事申诉公开审查工作中面临着启动程序较随意、适用率不高、主持人选择有争议、受邀人员选任不规范等问题。因此要充分发挥刑事申诉公开审查的积极作用,应通过规范公开审查启动机制、健全公开审查主持人指定机制、完善受邀人员邀请机制等措施不断进行完善。
As an important way to deepen public prosecution and enhance transparency in handling criminal appeal cases, the public examination of criminal appeal is beneficial to achieving fairness and justice in the prosecution work of criminal appeal and enhancing the credibility of the procuratorial organs in law enforcement. However, at present, the public examination of criminal appeal is faced with problems such as the relatively casual initiation process, the low application rate, the controversial choice of the host, and the irregularities in the selection of invited personnel. Therefore, in order to give full play to the positive role of public examination of criminal appeal, we should constantly take such measures as regularizing the initiation mechanism for public review and launching, improving the appointment mechanism of the hosts for public review and improving the invitation mechanism for invited persons to make it perfect.
