摘要

近年来,海洋经济快速发展,海岛的重要性日益凸显,如何科学保护与开发利用无居民海岛成为一个越来越重要的议题。2010年3月1日,《海岛保护法》正式实施,表明我国首次以立法的形式加强对海岛的保护与管理。本文分析了国外有关海岛的立法制度,剖析了由于制度的缺失,地方在依法管岛、依法治岛的过程中,无居民海岛保护与利用所存在的主要问题,并重点提出了地方在加强海岛立法时应明确细化的几点建议。
        In recent years,the importance of the islands is standing out gradually with the country’s rapid economic development.The issue of scientifically developing and utilizing the islands is getting more and more attention.By the China’s"Island Protection Act"came into force On March 1,2010,it was the first time symbolized the country had strengthened the protection and utilization of the islands in the form of legislation.Due to the lack of management system,the main problem of the local government in the process of protection and utilization the islands without inhabitants will be analyzed in this paper,and also,a few clarified and specified suggestions are proposed for the local government strengthening island legislation in the paper.
