欺诈投保下保险人之撤销权探析——基于2014—2017年40件司法判例

摘要
自2009年"不可抗辩"条款的法条化后,保险实务中关于投保欺诈问题,是否适用《合同法》之撤销权即产生巨大争议。本文从法理角度论述在欺诈投保下,合同撤销权与解除权不构成法条竞合,且合同撤销权的适用不仅未与保险法"不可抗辩"条款的立法目的相悖,而且有助于法体系之统一,不能以"不可抗辩"条款来排除合同撤销权之适用,并应对保险合同撤销权的具体行使进行规制。
Since the legalization of the "incontestability" clause in 2009, the issue of insurance fraud in insurance practice has caused great controversy as to whether the revocation right in the Contract Law can be applied to a fraud insurance case. From the perspective of jurisprudence, the paper argues that under the fraud insurance, the contract revocation right and the rescission right do not constitute the overlap of articles of law, and the application of the contract revocation right is not contrary to the legislative purpose of the "incontestability" clause of the insurance law, instead, it contributes to the uniformity of the legal system. Therefore, the application of the right of contract cancellation cannot be ruled out by the "incontestability" clause, and the application of revocation right in insurance contract should be regulated.
