关于夫妻共同债务认定的最新解读——试评审理夫妻共同债务纠纷的最新司法解释

摘要
2018年1月18日,最高人民法院发布《关于审理涉及夫妻债务纠纷案件适用法律有关问题的解释》(以下简称《解释》),共规定四条司法解释,本着裨补缺漏的原则,对夫妻共同债务纠纷的认定标准、排除以及举证责任的分配进行了改进和细化,最大限度地减少极端案件的发生。本文主要针对该《解释》的立法背景、立法目的以及适用问题进行初步探讨,寻求建构夫妻共同债务认定规则的完整框架。
On January 18,2018,the Supreme People's Court issued a judicial interpretation of the dispute over joint debts between husband and wife. There is a total of four judicial interpretations. Based on the principle of finding and supplementing vacancies,the criteria for determining the common debt disputes between husband and wife,their exclusion and the distribution of the burden of proof are improved and refined in order to reduce the occurrence of extreme cases. This paper mainly discusses the legislative background,legislative purpose and applicable issues of the judicial interpretation,and seeks to establish a framework for joint debt recognition rules for couples.
