取道竞争法:我国新闻聚合平台的规制路径——欧盟《数字版权指令》争议条款的启示

摘要
自欧盟颁布《数字版权指令》及其数个修正案以来,其"链接税"条款和"过滤器"条款对新闻出版者的"倾斜式"保护与加强网络平台审查责任的要求引发了公众的广泛讨论。在利益平衡视角下,通过分析法案出台过程中的各方争议焦点,并结合德国、西班牙两国未达预期的立法实践,可以判断该两条款的出台难以缓解,甚至可能激化当前由新闻聚合技术引发的利益纠纷。从我国现有立法和司法实践来看,《数字版权指令》两争议条款出台带来的启示是,新闻聚合纠纷宜以竞争法,而非版权法予以规制,方能在促进社会创新的同时更好地实现利益平衡。
Since the EU enacted the Directive on Copyright in the Digital Single Market and its several amendments,the partial protection of the press and the requirement to strengthen the review responsibility of online platforms in Link Tax Article and Upload Filter Article have led to widespread public discussion. From the perspective of balance of interests, by analyzing the focus of disputes in the process of the introduction of the bill and the legislative practice of Germany and Spain which did not meet expectations, it can be judged that the enactment of the two clauses is difficult to alleviate and may even intensify the current interest disputes caused by news aggregation technology. Judging from the existing legislation and judicial practice in China, the enlightenment brought about by the two clauses of the bill is that news aggregation disputes should be regulated by competition law rather than copyright law, to promote social innovation and achieve a better balance of interests.
