民法典编纂视角下保证人先诉抗辩权限制的立法完善

摘要
先诉抗辩权作为一般保证人的专属抗辩事由,在当前制定民法典物权编的视角下,这一权利对维护保证人的合法权益,平衡保证关系中各方的利益具有举足轻重的作用。对目前我国立法中先诉抗辩权限制的局限性进行分析,阐述我国立法对先诉抗辩权限制存在的不足,借鉴其他国家的立法经验对民法典物权编编纂中先诉抗辩权限制的完善提出了建议,从而能够推动权利运作的规范性要求,维护债权人的利益。
        In the context of the current formulation of the Civil Code property rights,the right to sue the right of counterfeiting as a general guarantor,can safeguard the legitimate rights and interests of the guarantor,balance between the interests of the parties to play a pivotal role. Through the analysis of the limitation of the right of preemption in the current legislation,the paper expounds the shortcomings of our legislation on the limitation of the right of precedent defense,and draws lessons from the legislative experience of other countries about restricting the guarantor's prelitigation demur right and then offers recommendations,all of which can promote the operation of the normative requirements,safeguard the interests of creditors.
