辛亥革命时期《云南森林章程》研究

摘要
1911年11月辛亥革命胜利后,云南军都督府颁布了一部森林保护的地方法规:《云南森林章程》。《云南森林章程》虽然是一项地方性法规,却是近代中国第一部涉及森林资源与森林治理的法规。这一章程不仅只是根据云南森林等自然资源丰富的实际情况而提出的一项森林资源利用的资源法规,而更是在云南特殊的生态环境背景下,针对森林等自然资源的可持续利用,提出的资源治理法规。《云南森林章程》也是我国第一部生态保护法规,在当时既是一项因地制宜的地方生态保护法规,更是一项在国家层面具有普遍意义的生态保护法规,可以为今天我国环境保护的法制建设提供历史借鉴。《云南森林章程》对森林等自然资源的认识不再仅仅局限于利用,而明确提出和强调了保护的概念,这使得《云南森林章程》不再是一部森林资源法规,而是一部真正意义上的生态保护法规,对我国开展依法治国与生态文明建设都有着积极的意义和一定的推动作用。因此,这一章程不仅可以为今天我国环境保护的法制建设提供历史借鉴,而且对当前我国进行绿色发展、生态文明建设与依法治国具有重要的现实意义。
In the period of Xinhai revolution,Yunnan Military Government has promulgated local regulations of forest protection "Yunnan forest regulation". Although it is a local law,it is the first regulation of forest resources and forest management in modern China. According to the situation of Yunnan forest and other natural resources,this regulation is not only for the use of forest resources,it is also a regulation on sustainable utilization and management of forest resources. "Yunnan forest regulation"is also the first ecological protection law in China. At that time,it was not only a local ecological protection law,but also has an important significance on the national level,it can provide a historical reference for the legal construction of environmental protection in China today. This regulation is no longer limited to the use of forest resources,but put forward the concept of protection,this makes the "Yunnan forest regulation"is no longer a forest resources regulation,but a real sense of ecological protection law,it has a positive meaning and a certain role in promoting the ruling the country by law and ecological civilization construction.
