村规民约在基层情境治理中的法治功能分析

摘要
基层单位之间有其差异性、特殊性、动态性的一面,需要重视基层社会的情境治理。村规民约依然是一种草根性的、有一定自发认同度的地方性治理资源,在基层情境治理中发挥着行为规制、法律补漏、民主参与和文化传承等多重功能。地方性的村规民约与普适性国家法之间存在违和之处,可以通过对地方性村规民约的改造和吸纳,在基层情境治理中以"硬法"为基础,"软法"为补充,充分发挥村规民约等地方性治理资源的效用,推动基层社会的有效治理。
Grass-roots units are dynamically different from each other with their own particularity and in their own situation, which calls for attentions to the situational governance of grass-roots society. As a kind of grassroots local governance resource with a certain degree of spontaneous identification, village regulations still play multiple roles in grassroots situational governance, such as behavior regulation, legal remedy, democratic participation, cultural inheritance, etc.. There are currently some contradictions between local village regulations and universal state laws. To solve this problem, we should absorb and reform local village regulations, take "hard law" as the basis with the supplement of "soft law", and give full play to village regulations and other local governance resources, so as to promote the effective governance of grass-roots society.
