农村宅基地流转现状及其问题分析

摘要
随着我国现代化进程的推进,农村现实情况发生了许多变化,以往限制宅基地流转的制度与现实要求产生了矛盾。通过描述农村宅基地流转现状及原因发现,限制农村宅基地流转不利于统筹城乡协调发展,造成大量土地资源浪费,并且形成不规范的宅基地隐形交易市场;相关法律模糊,但是为宅基地流转留下政策空间等问题。在参考以往文献和总结现实经验的基础上,提出放宽农村宅基地流转限制、建立规范有序的农村宅基地流转市场、借助"三权分置"思路改造农村宅基地使用权、借鉴地方各省政策法规经验等几条政策建议。
With the advancement of our country's modernization process,the reality of rural reality has changed a lot.In the past,the system of restricting the transfer of homesteads has contradicted the reality.By describing the current situation and reasons of rural homestead circulation Coordinated development of urban and rural areas,this paper has found the problems that restricting the circulation of rural homestead is not conducive to co-ordination,resulting in a large number of land resources waste,and the formation of non-standard homestead stealth trading market.And the relevant law is vague,but for the homestead transfer policy space.On the basis of referring to the previous literature and summing up the practical experience,this paper puts forward some suggestions to relax the restriction of circulation of rural homestead and establish the market of rural homestead distribution in an orderly manner; reform the right to use the rural homestead with the idea of"Three separate"and learn from local provincial policies and regulations.
