“净身出户”离婚协议的法律效力

摘要
离婚协议是双方当事人自愿离婚的意思表示以及对子女抚养、财产及债务处理等事项协商一致而达成的协议或者意见。近年来,"净身出户"离婚协议产生的财产分割纠纷时有发生,依照现行相关司法解释,此类协议一方反悔即属无效。本文结合离婚协议是否为《合同法》所调整、意思自治在离婚协议中的体现、夫妻财产约定制在离婚协议中的适用以及当下社会现状等方面,论证了离婚协议中财产分割约定部分应当有效。
Divorce agreement is the intention of the parties to the voluntary divorce,as well as the child support,property and debt settlement agreement reached by the agreement or advice. "Get out" divorce disputes in recent years is particularly prominent,mainly to the division of property disputes.According to applicable judicial explanation,this type of agreements turns to be void if one party changes his idea.The author thinks,cleanse the property part of households divorce shall be effective in registration before the divorce.This paper will combine the divorce agreement is adjusted,embodiment of autonomy in the divorce agreement,the marital property agreement system applies in the divorce agreement,and combined with social status etc.to discuss the divorce agreement in part of the property in the divorce registration effectively.
