摘要

2015年8月,《刑法修正案(九)》正式获得通过,这是在《刑法修正案(八)》基础上的一次修正。将以《刑法修正案(九)》为主要视角,在宽严相济的刑法基本政策下,立足于我国现阶段的现实情况,探析我国死刑改革的进程以及未来的改革之路。
        In August 2015, Amendment to Criminal Law(Ⅸ) was formally adopted, which was an amendment based on Amendment to Criminal Law(Ⅷ). This paper takes Amendment to Criminal Law(Ⅸ) as the research object, analyzes the process of the reform on death penalty as well as the road of reform in the future based on the basic policy of criminal law on tempering justice with mercy, and considering the reality of our country at the present stage.
