企业专利质量管理探析

摘要
企业专利质量包括技术质量、法律质量和市场质量三方面含义。提出影响专利质量的关键因素:客体因素是专利的技术质量和法律质量,主体因素是将技术方案转化为专利文件的各关键角色。围绕关键角色,对三种经典的企业专利质量管理模式进行探析,对标分析得出现有企业存在的主要问题,并提出对策建议:1)提高发明人(研发人员)的专利保护意识和技术创新高度;2)加强专利工程师在专利申请中的参与程度;3)建立完善的专利评审体制机制;4)营造促进专利代理人能力提升的准入环境;5)加强专利审查员与研发人员的沟通。
The enterprise patent quality includes three aspects: technological quality, legal quality and market quality. The key factors affecting the patent quality are proposed: the object factor is the technological quality and legal quality of the patent, the subject factor is the key roles in transforming the technological solutions into patent documents. Focusing on the key roles, three classic enterprise patent quality management modes are explored, benchmark analysis is carried out to find out the main problems existed in the existing enterprises, and countermeasures are proposed: 1) Improve the patent protection awareness and technological innovation height of the inventors(R&D personnel); 2)Strengthen the participation of patent engineers in patent applications; 3) Establish a sound patent review system; 4) Create an access environment to promote the capacity of patent attorneys; 5) Strengthen the communication between patent examiners and R&D personnel.
