捕后羁押必要性审查的理论探寻与实证分析

摘要
新刑事诉讼法第九十三条增设了捕后羁押必要性审查制度,强化了检察机关对被告人审前羁押必要性的法律监督,切实落实了对犯罪嫌疑人的人权保障。但在司法适用中,羁押必要性审查的运作还存在审查方式单一、缺乏有效的衔接机制、操作程序不具体、易引发风险等诸多问题,应从丰富审查方式、建立衔接机制、细化审查标准、完善配套机制等方面寻求完善路径。
Necessary examination systems for post-arrestation detention added to article ninety-three of New Criminal Procedure Law intensifies the procuratorates' legal supervision over the necessity of the defendants' pretrial detention, effectively implementing protection of criminal suspects' human rights. However, in judicial application, the operation of necessary examination of the detention still witnesses monotonous examination method, lack of effective cohesion mechanism and specific operation program, causing various risks. Accordingly, efforts need to be made to search for and inprove approaches to diversification of examination methods, establishment of cohesion mechanism,detailing of examination standards and improvement of support mechanisms.
