人类共同继承财产原则在国际海底区域适用研究

摘要
人类共同继承财产原则是《联合国海洋法公约》规定的重要法律原则,是海洋法在国际海底区域的重要应用,对解决国际海底区域及资源权利归属,促进海洋资源公平合理分配和利用具有重要意义。从人类共同继承财产的界定和法律属性出发,在国际法的框架下依据《联合国海洋法公约》对人类共同继承财产原则的主要内容和适用范围进行阐释,结合中国相关实践发现,当前人类共同继承财产原则存在适用界定不清、惠益分享有待细化、发达国家认可度低和管理机构影响有待加强等适用困境。从国际法角度提出人类共同继承财产原则的发展路径。明确界定人类共同继承财产及原则适用,进一步丰富和完善惠益分享制度,加强人类共同继承财产原则的国际立法与实践,充分发挥国际海底管理局作用。结合中国对人类共同继承财产原则的立法与实践,以及适用与发展等方面的研究分析,证明中国在人类命运共同体理念下担起大国使命,为国际法体系建设和人类共同继承财产原则的发展和完善作出更大贡献。
The principle of the common heritage of mankind is an important legal principle stipulated in the United Nations Convention on the Law of the Sea(UNCLOS). It is an important application of the law of the sea to international seabed areas, which is of much significance to solving the problem of the ownership of international seabed area and resources, and promote the fair and reasonable distribution and utilization of marine resources.Starting by the definition and legal attributes of the common heritage of mankind, this article interprets the main content and scope of the principle of common heritage of mankind in the perspective of international law, and analyzes the dilemma and the path of the Principle of Human Inheritance of Property in international law.
