论药品安全犯罪的司法认定

摘要
由于刑事立法的粗疏,药品安全犯罪在司法认定中存在诸多问题。假药和劣药在实践中难以区分,区分的意义也不大,反而会导致罪刑失衡。因此,应当不再区分假药和劣药,而是以抽象概括的方式对假药作出规定。医疗机构生产、销售假药、劣药的认定在实践中存在争议,医疗机构使用假药、劣药完全符合生产、销售假药、劣药罪的构成特征,但鉴于其性质更为恶劣,危害更大,应当在该罪中增加一款,加重对此类行为的处罚力度。在实践认定中,注意生产、销售假药罪与以危险方法危害公共安全罪的界限问题,防止以危险方法危害公共安全罪的恣意扩张。
Due to the carelessness of criminal legislation,there are many problems in the judicial identification of drug safety crime.Counterfeit drugs and inferior drugs are difficult to distinguish in practice,and the meaning of distinction is not large.Therefore,we should no longer distinguish between counterfeit and inferior drugs,but instead make provisions for counterfeit drugs in an abstract and general way.There are disputes in the practice of the production,sale of counterfeit drugs and inferior drugs in medical institutions.The use of fake drugs and inferior drugs in medical institutions is fully conformed to the characteristics of the crime of producing,selling fake and inferior drugs.However,in view of its worse nature and greater harm,one of the crimes should be added in this crime to aggravate the punishment of such behavior.In practice,we should pay attention to the crime of producing and selling fake drugs and the limit of the crime of endangering public safety by dangerous methods,so as to prevent the unscrupulously expansion of the crime of endangering public safety by dangerous methods.
